Release, Covenant not to sue, 

and Indemnification Agreement

            That, I,  (individually, or as legal guardian/parent of , a minor), desire to release and indemnify KuGar Taekwondo, Jesse Kuhns, and Clarissa Kuhns from any and all claims relating to any activities, specifically including but not limited to, engaging in martial arts training, classes, and competitions and further desire not to participate in any lawsuit against KuGar Taekwondo, Jesse Kuhns, and Clarissa Kuhns, relating to any activities in connection with my participation in martial arts training, classes, and competitions. 

              Now, therefore, for good and valuable consideration acknowledged by the signature hereinbelow, I agree to each of the following:

            I hereby release and discharge KuGar Taekwondo, Jesse Kuhns, and Clarissa Kuhns and their affiliates, partners, managers, attorneys, employees, agents, servants, officers, directors, volunteers, and sponsors from any and all suits, actions, causes of actions, demands, damages, costs, expenses, negligence, gross negligence, or claims of any character, type or description, that I now, or may at any time in the future, have, incur, sustain, or suffer for any losses, injuries, or damages arising out of, resulting from or relating to, any activities in connection with my participation in martial arts training, classes, and competitions.

            I agree that I will not and/or shall not sue, prosecute, or participate in any claim or lawsuit against KuGar Taekwondo, Jesse Kuhns, or Clarissa Kuhns or their affiliates, partners, managers, attorneys, employees, agents, partners, servants, officers, directors, volunteers and sponsors for any losses, injuries, or damages arising out of, resulting from or relating to any activities, including my own, in connection with my participation in martial arts training, classes, and competitions.

            I  agree to indemnify and hold KuGar Taekwondo, Jesse Kuhns, and Clarissa Kuhns and their affiliates, partners, managers, attorneys, employees, agents, servants, officers, directors, volunteers, and sponsors harmless, from and against any and all suits, actions, causes of actions, demands, damages, costs, expenses, expenses of litigation, expert witness fees, court costs, reasonable attorney’s fees, negligence, gross negligence, or claims of any character, type or description, relating to, or brought, or made for, or on account of, or arising out of any losses, injuries, or damages that I now, or may at any time in the future, have, incur, sustain or suffer as a result of, or which relate to any activities in connection with my participation in martial arts training, classes, and competitions. I agree that the above and foregoing indemnity obligations or provisions expressly include the negligence, gross negligence, contributory negligence, comparative negligence, comparative responsibility and/or proportionate responsibility, if any, of KuGar Taekwondo, Jesse Kuhns, and Clarissa Kuhns and their affiliates, partners, managers, attorneys, employees, agents, partners, servants, officers, directors, volunteers, and sponsors, whether such negligence, gross negligence, contributory negligence, comparative negligence, comparative responsibility, and/or proportionate responsibility, if any, was or is a contributing cause or the sole cause of any claims, causes of action, liabilities, or damages.

            By executing this Instrument, I acknowledge that martial arts training, classes, and competitions, by their very nature, are inherently dangerous. I further understand that serious injury or even death can occur by virtue of participation in martial arts classes, training, and competitions. Injury can occur during any combination of stretching, exercising, running, jumping, sparring, kicking, punching, tripping, grabbing, poking, pulling, choking, hurling, etc. Martial arts classes, training, and competitions involve kicks, punches, and other blows that are directed at the head, face, neck, abdomen, arms, legs, and other parts of the body. Injury can be inflicted by accidental and intentional contact or through slipping or tripping. By engaging in martial arts classes and training, I hereby assume all risks associated with martial arts training, classes, and competitions.

            I FURTHER HEREBY RELEASE, DISCHARGE, AND WILL INDEMNIFY AND HOLD HARMLESS KUGAR TAEKWONDO, JESSE KUHNS, AND CLARISSA KUHNS, THEIR AFFILIATES, PARTNERS, MANAGERS, ATTORNEYS, EMPLOYEES, AGENTS, SERVANTS, OFFICERS, DIRECTORS, VOLUNTEERS, AND SPONSORS FROM ANY CLAIMS OR DAMAGES RESULTING FROM THEIR OWN NEGLIGENCE OR GROSS NEGLIGENCE ARISING FROM MY PARTICIPATION IN MARTIAL ARTS TRAINING, CLASSES, AND COMPETITIONS.

I agree, represent, and warrant that before executing this instrument, I have read it and its terms, conditions and effects.

I agree, represent, and warrant that before executing this instrument, I have been advised that I could have this instrument reviewed and explained to me by an attorney of my choice.

I agree, represent, and warrant that before entering into and executing this instrument, I fully understand and comprehend all of the terms and provisions contained herein. If necessary, I have also had this instrument explained to me in Spanish.

            I agree that in the event that any paragraph, sentence, provision or term in this instrument is found to be in violation of law, the remainder of this instrument shall retain full validity and shall be enforceable against me.

I agree, represent and warrant that I am legally, physically, and mentally competent to enter into and execute this instrument and that I have the authority to execute same, either on my own behalf or on the behalf of my minor child/ward.   

            I agree, represent and warrant that this instrument is binding on my heirs, administrators, executors, successors and assigns.

My signature on this document is evidence that I know and understand and have had this document explained to me, that I fully understand the dangers that are inherent when participating at KuGar Taekwondo. I agree to the terms and conditions of this waiver form. I agree to the policies applied for all students of KuGar Taekwondo presented at the time of registration and future changes implemented.
